Healthier Comforts Creator & Community Sampling Terms

1. Overview & Program Scope

These Creator & Community Sampling Terms and Conditions ("Terms") govern all creator seeding, product sampling initiatives, beta evaluations, review reward programs, and social media promotions operated by Healthier Comforts ("Healthier Comforts", "we", "us", or "our").

By accepting complimentary product samples, completing associated surveys or feedback forms, tagging official Healthier Comforts social media handles, using designated campaign hashtags, or submitting content to us, you ("Creator", "Participant", or "you") agree to be bound by these Terms.

2. User-Generated Content (UGC) License & Grant of Rights

In consideration of the complimentary products provided and/or promotional incentives (gift cards, store credit, discount codes, or other perks), Participant grants Healthier Comforts a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully paid-up, transferable license to:

  • Display & Distribute: Use, reproduce, publish, distribute, perform, broadcast, and publicly display any submitted reviews, feedback, quotes, still photographs, video recordings, audio, recipe variations, and decorated content ("User Content").

  • Multi-Channel Media: Publish User Content across all brand channels, including but not limited to organic social media (Instagram, TikTok, YouTube, Pinterest, Facebook, LinkedIn), digital and paid advertising, email campaigns, website landing pages, retail pitch decks, and printed marketing collateral.

  • Editing & Adaptation: Resize, crop, caption, format, translate, excerpt, or create derivative works from User Content, provided such edits do not materially alter the authentic sentiment or artistic integrity of the work.

  • Name & Likeness Attribution: Use Participant’s name, social handle, profile image, and publicly shared likeness in connection with the User Content to give proper attribution and credit.

3. Content Ownership & Authentic Expression

  • Creator Ownership: Participant retains original copyright ownership of all submitted or posted photography, video, and creative assets.

  • Authentic Reviews: Healthier Comforts is committed to clean, honest product feedback. Survey responses, performance assessments, and reviews must reflect Participant's genuine experience with the product. Honest technical critique is welcomed and will not disqualify a participant from receiving eligible rewards.

  • Third-Party Rights: Participant represents and warrants that their User Content is their original creation and does not infringe upon any third-party intellectual property, privacy, publicity, or trademark rights.

4. Reward Corroboration & Fulfillment

  • Verification Requirement: Promotional incentives (such as digital gift cards or store credits) are subject to verification and corroboration by our team. Verification requires: (1) verified completion of the corresponding feedback survey, (2) an active, public social media post tagging official brand channels (where applicable for media tiers), and (3) email notification to creators@healthiercomforts.com from the email address matching the survey submission.

  • Program Limits: Unless explicitly stated otherwise in specific campaign guidelines, rewards are limited to one per creator/household per product campaign or sample run.

  • Distribution & Valuation: Rewards are delivered digitally within 2 to 5 business days following successful corroboration. Rewards, gift cards, and store credits hold no cash surrender value and cannot be exchanged for cash.

5. Regulatory Compliance & Endorsement Disclosures

In accordance with Federal Trade Commission (FTC) Guides Concerning the Use of Endorsements and Testimonials in Advertising:

  • Conspicuous Disclosure: Creators receiving free product samples or incentives must clearly and conspicuously disclose their material connection with Healthier Comforts in all related public social media posts and videos.

  • Placement: Disclosures must be prominent and easily visible to viewers (e.g., in the opening lines of video captions, via on-screen video text overlays, or through standard platform tags such as #gifted, #sample, or #HealthierComfortsPartner).
